1. Overview

1.1 GateLive has formulated this policy in order to enable the streamer (hereinafter referred to as "you") to clearly understand the boundaries of prohibited behavior when making live stream or live-related activities, and to ensure the healthy development of Gate.io.
1.2 This policy is formulated based on the Gate.io User Agreement , Gate.io Privacy Policy (collectively referred to as "Gate.io Terms of Service"). You must abide by it, otherwise you will be punished accordingly. The severity of violations will be comprehensively assessed by GateLive based on factors such as the impact, the number,the time and the subject of the violation. By accepting and agreeing to these regulations, you are deemed to have agreed and accepted the Gate.io Terms of Service.

2. Types of Violation

2.1 Basic Rules

2.1.1 You are not allowed to use the influence of LIVE to violate laws and administrative regulations during and outside of LIVE.
2.1.2 You are responsible for ensuring that the LIVE environment is healthy and orderly. And you are responsible for the co-streamer and LIVE room information in the LIVE room. If you violate the above part, GateLive will punish you accordingly .
2.1.3 You should be responsible for the relevant activities, content generated by you on GateLive and the influence of you inside and outside GateLive, and those subject to this policy. That is, the streamer is responsible for including but not limited to LIVE images, background information, audio, video, title, cover, profile photo, introduction, comment, picture, QR code, text chain, URL, hyperlink and other text, audio and video content and streamer influences inside and outside GateLive.
2.1.4 You should be cautious in your words and deeds outside GateLive, and keep your good impression and reputation of GateLive. If your words and deeds damage the reputation of GateLive and affect normal operation, we will punish you according to the relevant rules of this policy.

2.2 Serious Violations (Category A)

It is strictly prohibited to promote, guide, incite or beautify the following content during live streaming, otherwise it will be directly identified as a serious violation, and you will be punished according to Category A penalties:

2.2.1 Safety, Violence and Threats
You must not engage in any content or activities that endanger the life and health of yourself and others, nor engage in any violence or coercion against others, including but not limited to:
- Use tools, weapons to physically threaten, intimidate, injure or kill yourself or others
- Trading with one's own life at stake
- Dangerous consumption of alcohol or other incapacitating substances
- Dangerous or distracted driving, such as LIVE while driving
- Other situations assessed by the admins of GateLive that may cause bodily harm;

2.2.2 Terrorism and Violent Extremism
You must not engage in terrorist or violent extremist content or activities, including but not limited to:
- Display or link terrorist or extremist propaganda, including related images, videos, texts, etc.
- Other situations that admins of GateLive reasonably determine may involve terrorism or violent extremism;

2.2.3 Sexual Content
You may not transmit (including through LIVE or other means, such as directing to other social media) obscene pornographic information and obscene pornographic performances, including but not limited to:
- Bare private parts
- Erotic games, anime, videos, pictures or websites (including but not limited to inducing users to join vulgar pornographic fan groups/welfare groups, etc.), etc
- Any action or performance that is vulgar and pornographic (including but not limited to simulated sexual gestures, display seductive actions, actions with the risk of going naked, touching each other, etc., that cause sexual fantasies and sexual shame, etc.)
- Other erasing and pornographic content determined by admins of GateLive that may bring a similar impression;

2.2.4 Youth Safety
You may not engage in any content or activity that endangers youth (defined in this policy as a Juvenile under the age of 18), including but not limited to:
- Content featuring or promoting child sexual abuse materials (CSAM)
- Content of sexual exploitation, sexual misconduct or solicitation of adolescents
- Illegal advertisements are detrimental to the physical and mental health of adolescents
- Instigating Juvenile to engage in criminal activities, and inducing Juvenile to commit suicide, etc
- Other situations that admins of GateLive assess that may endanger juveniles;

2.2.5 Illegal Activities
You must comply with all applicable local, national and international laws and refrain from any illegal activity, including but not limited to:
- Engage in any form of human trafficking, including sex trafficking, sale of children, forced marriage or domestic servitude
- Buying and selling illegal drugs, firearms or counterfeit goods on Gate.io
- Committing or assisting in the destruction, defacement or theft of public property or the property of others without permission on Gate.io
- Other situations that admins of GateLive assess that illegal activities may be involved;

2.3 General Violations (Category B)

It is prohibited to promote, guide, incite or beautify the following content in LIVE activities. If you are a first-time offender, you will be considered a general violation and will be punished according to Category B penalties: For repeat offenders or serious violations, you will be upgraded to Category A penalties:

2.3.1 Intellectual Property Rights
You may not LIVE that you are not authorized or authorized to share, including but not limited to:
- Unauthorized streaming of other streamers' live content on GateLive, whether the form is LIVE or recorded;
- LIve streaming of LIVE, record or video content from other live stream platforms;
- Music you are not authorized or authorized to share, including music played in the background of the player
- Goods or services protected by trademark
- Other situations than admins of GateLive assess that it may involve infringement of the intellectual property rights of others;

2.3.2 Privacy Protection
You shall not disseminate any content that intentionally or may disclose confidential information of others (including natural persons, legal persons and other organizations), including but not limited to:
- Promote LIVE content in titles or other places with the gimmick of snooping on others' privacy;
- Disclosure of other people's identity information (including but not limited to malicious disclosure Gate.io accounts, UID, real names and ID numbers, phone numbers, home addresses and other personal (privacy) information, etc.);
- LIVE to those who do not voluntarily participate in LIVE in places where the privacy of others is easily exposed, such as in closed places like toilets, locker rooms, public transportation (such as subways, buses), or inaccessible places like fields, parks, and suburbs;
- Disclose the salary status, business information, operational information and other information of your personal or affiliated agency or other agency, or do other acts that may cause unfair competition between streamer and agency;
- Other situations than admins of GateLive assess that may involve infringement of the privacy of others;
Note: Personal Confidential Information includes personal privacy Information and Information that has been made public but is not licensed for use in LIVE shows.

2.3.3 Legitimate Interests and Content Compliance
You shall not infringe upon the legitimate rights and interests of others, the legitimate interests of GateLive, or disrupt the normal order of GateLive, including but not limited to:
- Incite others' emotions, attack, ridicule, discriminate, isolate the other people, or use their own influence to cause war or engage in group disputes or scold wars with other groups;
- Insulting others, intentionally fabricating facts to slander others, disseminating information that insults or defames others; direct or insinuating personal attacks on others;
- Let viewers or followers slander and smear others without stopping them in time;
- Without prior consent, you post any fundraising content in your personal capacity;
- Use and display content or techniques that disrupt the normal procedures of the game, including but not limited to using illegal means to obtain benefits in the game, selling, using, and sharing game cheating software, vulnerability, assistive tools, etc. in LIVE;
- Malicious or passive live streaming games or promotional content, including but not limited to in-game swiping, screen peeping (including hacking teammates in the game), actors, sniping, malicious use of bugs, Away From Keyboard, meaningless content, use of poor image quality, etc.;
- Live streaming meaningless content, including but not limited to negative behaviors such as long-term Away From Keyboard and coping LIVE, such as streaming sleeping, black screen Away From Keyboard, long-term freeze frame of the same or similar screen, etc.
- Promote other similar platforms, induce and incite users to use or watch other similar platforms;
- Publish advertisements on the GateLive without prior consent, including but not limited to hanging QR codes, graphics, videos, websites, voice calls, press conferences, etc., and divert GateLive users to third-party apps;
- Carry out activities under the official name of GateLive without the permission of GateLive;
- Slander or damage the image of GateLive in any way, publish false information and malicious information related to GateLive within GateLive or through other online media and social media, such as misinterpret or mislead others through WeChat, Twitter, misunderstand GateLive policies and regulations, streamer cooperation methods;
- Acts that infringe upon the legitimate rights and interests of GateLive, hinder the normal operation of GateLive, undermine the fairness of GateLive services or other acts that affect the normal operation order of GateLive software, including partnership cheating, using Cheating Software or other cheating software, using BUG (also known as "Vulnerability" or "defect"), maliciously opening multiple accounts(Including using platform reward policies to guide previous users to re-register Gate.io accounts),etc.;
- Other content assessed by GateLive admins may involve infringement of the legitimate rights and interests of others and GateLive, and that may adversely affect the ecology of the LIVE industry;

2.4 Minor Violations (Category C)

It is prohibited to promote, guide, incite or beautify the following content in LIVE activities. If you are a first-time offender, you will be considered a minor violation and will be punished according to Category C: For repeat offenders or serious violations, you will be upgraded to Category B or Category A penalties:
- Use uncivilized language, continue to use foul language and abuse;
- Vulgar, indecent and other makeup that violates public order, good customs and social morality;
- Smoking and drinking alcohol in LIVE. It is strictly forbidden to live streaming after drinking. If you live streaming after dunk and sound sleep,perform other drunkenness behavior, this will be regarded as serious;
- Post borrowing money from others, ask for passwords or other information involving property;
- Maliciously select the wrong partition without following the LIVE partition requirements;
- Display off-GateLive transaction information, including but not limited to: displaying logos of other exchanges, using third-party transaction software.etc;
- Deliberately displaying comments, bullet comments or contact information from outside in the live room;
- Users post contact information in room, but you don't stop and delete their comments in time;
- Fabricate facts or maliciously report In live room;
- Other GateLive assesses that the impact is minor, but the behavior disrupts the order of GateLive.

2.5 Supplementary Notes

1. "Repeated Offenders": The same GateLive account has 2 or more violations of the same type in Category A, Category B, and Category C within 12 consecutive months.
2. "Serious circumstances":
(1) The violation is a recidivist;
(2) The violation causes damage to Gate.io including but not limited to property and goodwill;
(3) Other serious circumstances assessed by these rules of conduct and GateLive rules.

3. Penalty Description

3.1 Description of Violations

If the streamer has violations, GateLive will punish according to the severity of the violation. It is divided into: serious violations (Category A violations), general violations (Category B violations), minor violations (Category C violations);

Violations of the relevant provisions of Part 2.2 of this policy shall be deemed serious violations (Category A violations); violations of the relevant provisions of Part 2.3 of this policy shall be deemed general violations (Category B violations); violations of the relevant provisions of Part 2.4 of this policy shall be deemed minor violations (Category C violations).

3.2 Penalty Rules of Violations

3.2.1 Violation Penalties-Category A
For violations that meet the description of this category, GateLive has the right to impose one or more of the following penalties:
1. Permanently cancel the right to participate in LIVE activities;
2. Disqualification from LIVE One to three years;
3. Be blacklisted and permanently cancel the LIVE permission;

3.2.2 Violation Penalties-Category B
For violations that meet the description of this category, GateLive has the right to impose one or more of the following penalties depending on the severity of the violation and the number of violations:
1. Verbal, written or systematic warnings remind rectification, and streamers that are within the warning rectification period will not be recommended;
2. Cut off live stream and restrict going live;
3. 7 to 365 days for users who send violating comments on mute;
4. Close live room for 1-90 days;
5. Cancel the recommendation qualification of live room/streamer for 1-90 days;
6. Cancel the right to participate in live events for 7-365 days;
7. Depending on the seriousness of the violation, the punishment shall be upgraded according to the Category A.

3.2.3 Violation Penalties-Category C
For violations that meet the description of this category, GateLive has the right to impose one or more of the following penalties depending on the severity of the violation and the number of violations:
1. Verbal, written or systematic warnings remind rectification, and streamers that are within the warning rectification period will not be recommended;
2. Cut off the live stream and restrict going live until the rectification is completed;
3. 30 minutes to 7 days for users who send violating comments on mute;
4. Close the live room for 2 hours-7 days;
5. Cancel the recommendation qualification of live room/streamer for 1-30 days;
6. Cancel the right to participate in LIVE activities for 1-180 days;
7. Depending on the seriousness of the violation, the punishment shall be upgraded according to the standard of Category B.

【Attention】

1. If your violation causes GateLive to suffer any damage, GateLive reserves the right to pursue corresponding damages or liability for breach of contract.
2. If your violation results in legal disputes or complaints, GateLive has the right to close the live account or cancel the live permission indefinitely after taking the aforementioned violation penalties.
3. If GateLive decides to punish the offending streamer, it will be notified by private message through WeChat, TG, etc. If the streamer has objections to the punishment, it must appeal through the above methods within 48 hours after receiving the GateLive notification; if the appeal is not filed within the time limit, it will be deemed to recognize the GateLive's punishment measures, and the streamer shall not refuse to perform on the grounds of being punished by GateLive.

4. Others

4.1 This policy is promulgated by GateLive, and GateLive has the right to modify and publicize this specification in a timely manner according to the development of GateLive and the requirements of relevant laws, regulations and policies.
4.2 This policy takes effect from the date of publication. If there is any modification after that, it will take effect from the date of publication of the modification.
